Welcome to PicBudd

These Terms of Service ("Terms") govern your access to and use of PicBudd's mobile application, website, and services (collectively, the "Service"). By using PicBudd, you agree to these Terms. If you don't agree, please don't use our Service.

1. Acceptance of Terms

By creating an account, downloading our app, or using any part of our Service, you agree to be bound by these Terms and our Privacy Policy. You must be at least 13 years old to use PicBudd. If you're under 18, you must have your parent or guardian's permission.

2. Your Account

Account Security

• You are responsible for maintaining the security of your account
• You must provide accurate and complete information
• You are responsible for all activities under your account
• Notify us immediately of any unauthorized access
• You may not share your account with others

Account Termination

You may delete your account at any time through the app settings. We may suspend or terminate your account if you violate these Terms or engage in harmful behavior.

3. Acceptable Use

You agree NOT to use PicBudd to:

• Share illegal, harmful, or offensive content
• Harass, bully, or threaten others
• Impersonate someone else or misrepresent yourself
• Share content that violates others' privacy or intellectual property
• Distribute spam, malware, or viruses
• Attempt to hack, reverse engineer, or compromise the Service
• Use automated systems (bots) without permission
• Share sexually explicit content involving minors
• Promote violence, discrimination, or illegal activities

4. Your Content & Our Rights

Your Ownership

You own the photos, videos, and other content you share on PicBudd. We don't claim ownership of your content.

License to Us

By uploading content to PicBudd, you grant us a limited license to:

• Store and transmit your content to deliver the Service
• Display your content to friends you've selected
• Make backup copies for reliability and recovery
• Use anonymized, aggregated data for analytics and improvements

Important: We will NEVER use your photos for advertising, sell them to third parties, or display them publicly without your permission.

5. Subscriptions & Payments

Premium Plans

• Billing: Subscriptions are billed monthly or annually based on your selection
• Auto-Renewal: Subscriptions automatically renew unless canceled
• Cancellation: Cancel anytime through your account settings. No refunds for partial periods
• Price Changes: We'll notify you 30 days before any price changes
• Free Trial: If offered, you'll be charged when the trial ends unless you cancel

Refund Policy

Payments are generally non-refundable except as required by law. Contact us at support@picbudd.com if you have concerns.

6. Privacy & Data Protection

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your information.

7. Disclaimers & Limitations

• We're not responsible for your device or internet connectivity
• We don't control what users share and aren't liable for user content
• Backup your important photos - we're not liable for data loss
• Our liability is limited to the amount you paid us in the last 12 months

8. Intellectual Property

The PicBudd name, logo, app design, and original features are our intellectual property. You may not copy, modify, or create derivative works without our permission. All trademarks and copyrights belong to their respective owners.

9. Third-Party Services

PicBudd may integrate with third-party services (payment processors, cloud storage, analytics). Your use of these services is subject to their own terms and privacy policies. We're not responsible for third-party services.

10. Changes to These Terms

We may update these Terms from time to time. We'll notify you of material changes via email or app notification. Continued use after changes means you accept the new Terms. If you don't agree, you must stop using PicBudd.

11. Dispute Resolution

If you have a dispute with PicBudd:

1. Contact us first at support@picbudd.com to try to resolve it
2. If we can't resolve it informally, disputes will be resolved through binding arbitration
3. You waive the right to participate in class action lawsuits
